Seeds from cannabis cultivars that produce flower with greater than 0.3% THC are no longer legal to ship out of state.<\/p>\n<p>Although seed buying will likely continue in authorized states, the modifications threaten to shutter some seed banks and genetics companies, observers say, while causing supply-chain problems for  https:\/\/nativesusa.com\/ (<a href=\"https:\/\/nativesusa.com\/\">nativesusa.com<\/a>) cannabis cultivators and retailers.<\/p>\n<p>&quot;If this wording goes through, we will need pop-up stores to offer seeds in every state where it&#8217;s permitted,&#8221; Campanella said. &quot;Which is why we&#8217;re also offering clones and tissue culture, because that&#8217;s not included in the bill.&#8221;<\/p>\n<h2>When are cannabis seeds and clones prohibited to ship across state lines?<\/h2>\n<p>The new regulations classify seeds depending on the THC capacity of the parent plant. Genetic substances such as seeds and clones are rendered illegal if the end product exceeds the threshold.<\/p>\n<p>For now, seeds are still shipping under the 2018 Farm Bill&#8217;s current quo. But the clock is ticking for enterprises like Brothers Grimm and for cannabis cultivators who fear supply chain interruptions if out-of-state access to genetics is prohibited.<\/p>\n<p>Most of the cannabis sector remains mostly unaware of the impending shutdown of the interstate genetics market, said Ryan Power, cofounder of Sebastopol, California-based breeder Atlas Seed.<\/p>\n<p>Without federal intervention in the way of a carve-out for seeds or an overall moratorium, many seed providers will just be shuttered come November, he added.<\/p>\n<p>&quot;We are operating legally now, but if that shifts, it will disrupt the legitimate licensed sector in every state,&#8221; said Power, whose clientele includes seed banks as well as licensed commercial cultivators.<\/p>\n<p>&quot;Customers are going to lose choice, and it will be a significant shutdown for many people.&#8221;<\/p>\n<h2>What are cannabis seed suppliers doing to remain legal after the government hemp ban?<\/h2>\n<p>Sagui Silber has previously recalibrated Silberhaze Genetics, his Ohio genetics company, because of state Senate Bill 56, which strengthened cannabis oversight in that state while also restricting hemp-derived THC items to licensed cannabis retailers.<\/p>\n<p>Previously a seed supplier, Silberhaze is now focused on the branding, preservation and IP protection of premium plant genetics.<\/p>\n<p>That&#8217;s because seed companies hoping to remain compliant in this updated environment must have solid documentation, he said.<\/p>\n<p>&quot;You have to prove where this material comes from, so it&#8217;s very important to have documentation, even to the extent where you have breeder names,&#8221; Silber said.<\/p>\n<p>&quot;Smaller businesses will have to operate with improved records and a stronger chain of possession,&#8221; he added. &quot;We need that documentation too, because we don&#8217;t want to be working with shady sources.&#8221;<\/p>\n<p>To prevent seizures and additional legal consequences, seed business owners must &quot;get their ducks in a row&#8221; before the new regulations take place, Silber said.<\/p>\n<p>&quot;Audit all your materials immediately, and categorize what you can,&#8221; Silber said. &quot;Take inventory, document your heritage, preserve cultivator records, and organize any cannabinoid or terpene data you currently have. If regulations change, you&#8217;ll be in a far better position to comprehend what may be impacted and make informed decisions.&#8221;<\/p>\n<h2>Does federal marijuana rescheduling impact cannabis genetics?<\/h2>\n<p>Silber believes U.S. Drug Enforcement Administration licensing may be necessary for companies engaged in research.<\/p>\n<p>But for now, seed houses can&#8217;t enroll with the DEA like state-licensed medical cannabis operators can. Such a pathway is unavailable to seed banks, nurseries or genetics companies, said Jim Ickes, a lawyer and partner with Frantz Ward&#8217;s cannabis practice group in Cleveland.<\/p>\n<p>&quot;Seed-related activity may be happening inside broader state-licensed therapeutic marijuana businesses, as some states permit dispensaries or registered therapeutic operators to offer seeds, clones or personal growing materials,&#8221; he said.<\/p>\n<p>&quot;But that is different from the DEA establishing a freestanding seed supplier registration category.&#8221;<\/p>\n<p>Some genetics companies are already changing operational practices to conform with the updated law. According to Ickes, they must address questions including:<\/p>\n<ul>\n<li>Which of our varieties produce plants over 0.3% total THC?<\/li>\n<li>Which seeds survive as hemp after Nov. 12, 2026, and which don&#8217;t?<\/li>\n<li>What does our inventory look like once we sort it against the genetics exclusion?<\/li>\n<\/ul>\n<p>Ickes also understands confusion from clients who believed government rescheduling of medical marijuana would resolve their story with financial institutions. However, the latest regulatory wording has moved those conversations beyond the fundamentals of classification, he said.<\/p>\n<p>&quot;Banks ask whether this particular revenue source is legal, whether it connects to state-licensed operations, or whether there&#8217;s interstate-commerce risk,&#8221; said Ickes.<\/p>\n<p>&quot;After November, a seed supplier selling high-THC genetics can&#8217;t answer the initial question with the hemp classification. It has to point to a lawful state cannabis pathway instead. Seed banks dealing in authentic industrial-hemp seed keep the cleaner story.&#8221;<\/p>\n<h2>What&#8217;s the outlook of cannabis genetics?<\/h2>\n<p>Campanella is part of a emerging coalition of other breeders, growers and researchers that&#8217;s saying seeds are more appropriately defined as farm inputs than controlled substances. To that end, seeds should be overseen by the U.S. Department of Agriculture, allowing the DEA to focus its enforcement work elsewhere.<\/p>\n<p>&quot;How do you regulate something based on what it might become one day?&#8221; said Campanella. &quot;Our choice is to have that language removed, or have seeds regulated by the USDA as a hemp product.&#8221;<\/p>\n<p>But in the meantime, Campanella is restructuring Brothers Grimm to operate outside the reach of shifting federal oversight.
